During a mediation, parties meet in separate rooms with their attorneys and the mediator, often a retired family law judge. The mediator shuttles back and forth, conducting diplomacy between represented parties until a deal can be struck or, in some cases, a partial deal, or until it becomes clear that no deal can be reached, in which case, the parties must proceed to trial.
